These Business Terms apply to businesses that create, claim, purchase, sponsor, or manage a listing, membership, Gigz campaign, gift-card reward, advertising campaign, promotion, or marketing service through 260Local.
By using 260Local as a business, you agree to these Business Terms and the general Terms of Use.
1. Business Eligibility
260Local is built for local businesses, restaurants, organizations, service providers, and community-focused brands.
A business must be legally authorized to operate and must have authority to claim, create, or manage the business listing.
260Local may approve, reject, suspend, remove, or limit business accounts, claims, listings, promotions, or Gigz at its discretion.
We may give preference to businesses that serve the 260 area code, Northeast Indiana, or nearby communities.
2. Business Information
Businesses are responsible for providing accurate information, including business name, address, phone number, website, hours, services, description, photos, offers, pricing details, service area, social media links, and contact details.
You agree not to submit false, misleading, outdated, stolen, or unauthorized content.
If you claim a listing, admin approval may be required before the listing is connected to your business account.
3. Listing Content
260Local may edit business listing content for clarity, formatting, grammar, SEO, readability, user experience, or platform consistency.
We may refuse or remove content that appears false, misleading, offensive, illegal, spammy, harmful, low quality, unverifiable, or unrelated to the business.
4. Offers and Promotions
Businesses are responsible for honoring any offers, coupons, discounts, or promotions they submit or approve.
Each offer should clearly state what is included, exclusions, expiration date, redemption rules, location limits, availability limits, and any required purchase.
260Local is not responsible for disputes between businesses and customers over offers.
5. Business Memberships, Payments, and Gift Cards
Business memberships, sponsored placements, advertising, promotional packages, or custom exposure plans may require payment.
Payment terms may vary by plan, invoice, proposal, agreement, or campaign.
For the Founding Restaurant Program, participating restaurants may be allowed to pay program fees by providing restaurant gift cards, gift certificates, promotional cards, or similar stored-value rewards accepted by the restaurant.
Unless otherwise agreed in writing, the standard Founding Restaurant Program fee is $200 per month, payable in gift cards or another approved payment method.
If a restaurant pays with gift cards, the restaurant is responsible for providing valid gift cards in the agreed monthly amount and for honoring valid gift cards distributed through 260Local.
Gift cards submitted to 260Local may be used for resident rewards, Gigz rewards, promotions, giveaways, community engagement, customer retention, or other 260Local program activity.
Gift cards submitted to 260Local are not refundable unless 260Local separately agrees in writing.
The business is responsible for complying with all laws that apply to its gift cards, certificates, promotional cards, expiration dates, fees, redemption limits, and disclosures.
Unless stated otherwise, payments are not refundable once work has started, a listing has been published, a campaign has launched, or promotional services have been delivered.
6. No Exclusive Category Rights Unless Written
A paid listing does not automatically give a business exclusive rights to a category, keyword, city, county, service type, or placement.
Any exclusivity must be agreed to in writing.
7. Advertising and Promotional Services
260Local may provide promotional services such as directory visibility, featured listings, local content, social sharing, sponsored posts, community engagement, resident Gigz campaigns, business spotlights, local guides, email or social promotion, and custom marketing support.
260Local does not guarantee sales, leads, rankings, revenue, or customer actions.
8. Gigz Engagement Campaigns
Some business plans may include resident engagement through 260Local Gigz.
Gigz may involve tasks such as viewing, sharing, commenting, submitting proof, checking information, visiting a location, supporting local content, or helping promote a business campaign.
Businesses understand that Gigz is designed to create real local awareness and participation. It does not guarantee customers, purchases, reviews, rankings, or platform-specific results.
The business is responsible for making sure each Gig is truthful, lawful, clear, and appropriate.
Gigz may not require residents to make false statements, post fake reviews, misrepresent their experience, harass others, infringe intellectual property, violate platform rules, or engage in unsafe, deceptive, illegal, discriminatory, or abusive conduct.
260Local may reject, edit, pause, or remove any Gig at its discretion.
9. Sponsored Content and Disclosures
If a resident receives or may receive value for posting, sharing, endorsing, reviewing, or otherwise promoting a business, the resident may be required to clearly disclose that relationship.
Businesses agree not to instruct residents to hide that they received a reward, gift card, payment, discount, or other benefit.
260Local may require disclosure language such as Sponsored, Ad, Rewarded by 260Local, Paid local promotion, or similar wording.
Businesses must not ask residents to post dishonest, misleading, or undisclosed endorsements.
10. Proof Review and Reward Approval
260Local, the business, or an authorized admin may review submitted proof for Gigz.
Proof may be approved, denied, delayed, or held for review.
A submission may be denied if the proof is incomplete, unclear, fraudulent, late, duplicated, unrelated to the Gig, violates instructions, violates platform rules, or appears abusive or manipulated.
260Local may reverse, withhold, delay, or adjust rewards in cases of suspected fraud, system error, duplicate submissions, resident misconduct, business dispute, or payment or reward issue.
11. Reviews and Reputation
260Local may allow users to leave reviews, comments, ratings, or feedback.
Businesses may not buy fake reviews, submit fake customer feedback, threaten users over honest opinions, manipulate ratings, use fake accounts, or ask residents to post dishonest reviews.
Businesses may not require residents to post positive reviews, fake reviews, or reviews that do not reflect a real customer experience.
260Local may remove reviews that appear fraudulent, abusive, irrelevant, or in violation of platform rules.
12. Business Responsibilities
Businesses agree to provide accurate information, honor approved offers, follow advertising laws, follow platform rules, respect users and residents, avoid false claims, avoid deceptive promotions, keep account information secure, and notify 260Local about important listing changes.
Businesses are responsible for honoring valid gift cards and rewards distributed through the program.
Businesses agree to cooperate in good faith if 260Local contacts them about a claim issue, redemption issue, proof dispute, resident complaint, or reward problem.
13. Gift Card and Reward Redemption Issues
If a resident reports that a gift card, certificate, offer, or reward was not honored, 260Local may contact the business for resolution.
If a business repeatedly fails to honor valid gift cards, rewards, or offers, 260Local may suspend the business, remove active Gigz, stop distributing its rewards, require replacement rewards, or take other appropriate action.
260Local is not responsible for a business's point-of-sale system, gift card balance system, redemption policies, staff training, restaurant operations, or customer service.
14. Content Rights
By submitting business content, you give 260Local permission to use, edit, publish, promote, and distribute that content in connection with the platform and related marketing.
This may include use on 260Local.com, social media, email campaigns, business spotlights, local guides, ads, promotional materials, and Community Enrichment Projects.
You represent that you have the rights needed to provide the content and that the content does not infringe another party's rights.
15. No Guaranteed Results
260Local may help businesses gain visibility, engagement, traffic, awareness, or leads.
260Local does not guarantee sales, leads, customers, revenue, visits, gift card redemptions, social media reach, follower growth, rankings, reviews, search engine results, resident participation, or business outcomes.
Marketing results vary by business, offer, location, campaign, audience, timing, and many other factors.
16. Cancellation
Businesses may request cancellation according to their plan, proposal, invoice, or agreement.
Unless otherwise agreed in writing, cancellation affects future participation only and does not require 260Local to return gift cards already submitted, distributed, or committed to a campaign.
Cancellation does not remove payment obligations for services already provided, campaigns already launched, gift cards already accepted, or agreed work already completed.
17. Suspension or Removal
260Local may remove, suspend, downgrade, or reject a business listing, account, claim, Gig, reward, or campaign if we believe the business has violated these Terms, misled users, failed to pay, failed to honor rewards, harmed the platform, or created legal, operational, safety, fraud, or reputational risk.
18. Independent Businesses
Businesses listed on 260Local are independent from 260Local.
260Local does not control their services, pricing, quality, employees, warranties, licenses, insurance, or customer interactions.
19. Limitation of Liability
To the fullest extent allowed by law, 260Local is not liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages related to business participation in 260Local.
260Local's total liability related to a participating business will not exceed the amount paid by that business to 260Local during the prior one-month period, or $200, whichever is greater.
